2. Personal data we collect

To provide our extrajudicial collections, factoring, and consulting services to the freight industry, we may collect:

Identification data (name, EIN/RFC, MC#/DOT#, address, phone, email)
Financial and asset data (accounts receivable, invoices, commercial contracts, BOL, rate confirmations, CFDI with Carta Porte complement when applicable)
Business contact data (position, company, jurisdiction)
Technical browsing data (cookies, IP address, browser, pages visited)

3. Purposes of processing

Primary purposes:

Management and recovery of assigned past-due accounts
Opening and administering accounts on the FreightCollections platform
Issuance of invoices and tax receipts
Compliance with legal and tax obligations across jurisdictions (US, Mexico, Canada)
Communication of case progress, reports, and payment promises

Secondary purposes (you may opt out at any time):

Communications about new services and AFS Academy publications
Statistical analysis and service improvement

4. Data transfers and disclosures

Your data may be transferred without requiring your additional consent to:

Competent US, Mexican, and Canadian authorities when legally required
Associated law firms for judicial recovery when applicable
Buró del Transporte for delinquency registration (with explicit consent)
Technology service providers under confidentiality agreements (HIPAA-grade where applicable)

We do NOT sell your personal information. We do not transfer your data to third parties for marketing or advertising purposes.

5. Your CCPA / CPRA rights (California residents)

If you are a California resident, you have the right to:

Know what personal information we collect, use, disclose, and sell
Delete personal information we collected from you
Correct inaccurate personal information
Opt out of the sale or sharing of your personal information (we do not sell, but you have the right)
Limit the use and disclosure of sensitive personal information
Non-discrimination for exercising your privacy rights

To exercise any of these rights, send a request to privacy@freightcollections.com with: full name, government-issued ID attached, right you wish to exercise, and detailed description. We will respond within 45 days (extendable by 45 additional days when reasonably necessary).

6. ARCO rights (Mexican residents)

Under Mexican Federal Personal Data Protection Law, you have the right to Access, Rectify, Cancel, or Oppose (ARCO) the processing of your personal data, as well as to revoke consent. To exercise these rights, send a request to privacy@freightcollections.com with the same documentation listed above. We will respond within 20 business days.

7. Cookies and similar technologies

Our websites use cookies to personalize your experience, remember language preferences, and analyze traffic. You can disable cookies through your browser settings. Disabling cookies may affect certain site functionality.

8. Data retention

We retain personal data only for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations (typically 5–7 years for financial and tax records), resolve disputes, and enforce our agreements.

9. Data security

AFS implements industry-standard security measures (encryption in transit and at rest, access controls, audit logs, employee training) to protect your personal data. However, no system is 100% secure; you acknowledge this inherent limitation.

10. Changes to this Policy

Any material modification to this Policy will be published on freightcollections.com and cobranzadeltransporte.com with at least 30 days' advance notice.

11. Freight Collections mobile application

Our iOS app ("Freight Collections") processes the following data, in addition to the practices described above:
Account credentials.The app authenticates you with your registered email and an app access key. Credentials are stored only in your device's secure Keychain and transmitted encrypted (HTTPS/TLS).

Push notifications. With your permission, we send notifications about payments registered on your cases. To deliver them we use OneSignal, Inc. as a technology provider, which processes a device push token and an internal user identifier. These identifiers are not used for advertising or cross-app tracking, and you may disable notifications at any time in your device settings.

Face ID / Touch ID. Biometric unlock is processed exclusively by iOS on your device. AFS never receives, stores, or has access to your biometric data.

Profile photo. If you choose to upload a profile photo, it is stored on our platform solely to personalize your account and can be replaced at any time.

Account and case data displayed in the app (balances, payments, case status) is the same data we process to provide our collection services under this policy.
